1. Identity and contact

The website esglaiart.es is operated by EsglaiArt, based in Barcelona, Spain. For any question about these terms you can write to info@esglaiart.es. We will reply through the same channel.

2. What the service is

EsglaiArt gives artists a space to publish artwork pages with images, description, technique, dimensions and, if they wish, a price, and to receive enquiries from interested people.

EsglaiArt is not a party to the sale of artworks: it does not collect the price, does not handle shipping or returns and does not act as a payment intermediary between artist and buyer. Any agreement is closed directly between the parties.

3. Creating and closing an account

• To publish work you must create an account and be of legal age.
• You must provide accurate information and keep your credentials confidential; you are responsible for activity carried out from your account.
• You can close your account at any time by writing to info@esglaiart.es. Closing it removes your artworks from the site.
• We may suspend or close an account that breaches these terms or applicable law, stating the reason unless legally prevented from doing so.

4. Artist obligations and authenticity of the works

• Only original, hand-made work by the person publishing it is accepted. Serial reproductions presented as originals, or third-party work, are not accepted.
• You declare that you are the author or hold the rights needed over the artwork and the images you upload.
• Published information (technique, dimensions, condition, price and availability) must be accurate and kept up to date.
• You are liable towards third parties for claims arising from a lack of authenticity or from any rights infringement in the work you publish.

5. Publication on the website and on Instagram

By publishing an artwork you allow EsglaiArt to display it on the site, in its listing pages and in search results, and to share it on the Instagram account @esglaiart.es, including posts and stories, always crediting the author where known.

This permission is non-exclusive, free of charge and revocable: you can turn off Instagram sharing from your dashboard or request removal of a post by writing to info@esglaiart.es. Removal of content already shared on social media will be carried out within a reasonable period.

6. Buyer enquiries

Enquiries sent from an artwork page are forwarded to the artist with the sender's email as reply-to address. EsglaiArt applies anti-spam and verification measures and may hold back or discard fraudulent or abusive messages.

EsglaiArt does not guarantee that enquiries turn into sales and is not responsible for the conduct of people who send messages.

7. Plans, payments and cancellation

• There is a free plan with a limited number of publishable artworks and a paid subscription plan that raises that limit.
• Subscription payments are processed by an external payment provider; EsglaiArt does not store your card details.
• The subscription renews automatically for equal periods unless cancelled. You can cancel at any time from your dashboard or by writing to info@esglaiart.es; you keep the plan until the end of the period already paid for.
• If, after downgrading, you exceed the published-artwork limit, you will be asked to choose which works stay published.
• If you are a consumer, you have the withdrawal rights granted by applicable law; write to us to exercise them.

8. Intellectual property

Rights over the artworks and their images belong to their authors. By publishing them you grant EsglaiArt a non-exclusive, royalty-free licence to host, display, resize and promote them on the site and its channels, solely for the purpose of promoting your work.

The brand, design, original texts and software of the site belong to EsglaiArt and may not be reused without permission.

9. Prohibited uses

• Publishing someone else's work, forgeries or content that infringes third-party rights.
• Publishing unlawful, violent, sexually explicit, discriminatory or misleading content.
• Sending spam or fraudulent messages, or impersonating others.
• Scraping data automatically, overloading the service or attempting to breach its security measures.

10. Availability and liability

The service is provided "as is" and may be interrupted by maintenance, technical incidents or causes beyond our control. We do not guarantee uninterrupted availability or specific commercial results.

To the extent permitted by law, EsglaiArt is not liable for indirect damages, loss of profit or agreements reached between artists and buyers. Nothing in these terms limits liability that cannot legally be excluded, including consumer rights.

11. Changes to these terms

We may amend these terms to reflect legal or service changes. The updated version will be published on this page and, where the change is significant, communicated to registered accounts. Continued use of the service implies acceptance.

12. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute will be heard by the courts designated by applicable law; if you are a consumer, by the courts of your domicile where the applicable rules so provide.
